Throughout these Terms and Conditions, “Company”, “we”, “our”, and “us” refer to GoodCar – Szymon Blacharski.

2. Product Description

BinPlus is a digital software product supplied electronically.

No physical goods are shipped.

After purchase, the customer receives instructions displayed within the software. To activate the software license, the customer may be required to send activation information to the Company by email according to the instructions provided within the application.

The Company reserves the right to modify, update, suspend, or discontinue any functionality of the software at any time.

3. Educational and Training Purposes Only

IMPORTANT NOTICE:

BinPlus is provided exclusively for educational, training, laboratory, research, testing, demonstration, and learning purposes.

The software is NOT intended for professional engineering, commercial deployment, vehicle certification, regulatory compliance, road vehicle operation, motorsport activities, public transportation systems, or any safety-critical application.

The software must not be relied upon as a professional diagnostic, calibration, validation, tuning, engineering, or safety tool.

Any use beyond educational and research purposes is entirely at the user’s own risk.

4. Prohibited Use

The software shall not be used:

  • In vehicles operated on public roads.
  • In vehicles participating in motorsport events.
  • In commercial transportation activities.
  • For safety-critical functions.
  • For aviation, marine, medical, military, emergency, or industrial control systems.
  • In any situation where software malfunction may result in injury, death, property damage, financial loss, regulatory violations, or environmental harm.

The user assumes full responsibility for compliance with all applicable laws and regulations.

5. No Warranty

The software is provided strictly on an “AS IS” and “AS AVAILABLE” basis.

The Company makes no warranties of any kind, whether express or implied, including but not limited to:

  • Merchantability.
  • Fitness for a particular purpose.
  • Accuracy of results.
  • Availability.
  • Reliability.
  • Compatibility.
  • Continuous operation.
  • Error-free operation.

The Company does not guarantee that the software will meet the user’s requirements.

The Company does not guarantee that defects will be corrected.

6. Service Availability

The software may require communication with external servers, activation systems, websites, email systems, or third-party services.

The Company does not guarantee uninterrupted availability of any server, website, activation service, or communication infrastructure.

Services may become temporarily unavailable due to:

  • Maintenance.
  • Technical failures.
  • Internet outages.
  • Cybersecurity incidents.
  • Third-party service interruptions.
  • Force majeure events.

The Company shall not be liable for any losses arising from service interruptions or unavailability.

7. Software Activation

Software activation procedures may require communication by email according to instructions displayed within the application.

Failure to correctly follow activation instructions may delay activation.

The Company does not guarantee immediate activation in all circumstances.

8. Limitation of Liability

To the maximum extent permitted by applicable law, GoodCar – Szymon Blacharski shall not be liable for:

  • Vehicle damage.
  • ECU damage.
  • Hardware damage.
  • Software corruption.
  • Data loss.
  • Loss of business.
  • Loss of profits.
  • Loss of income.
  • Loss of contracts.
  • Loss of reputation.
  • Downtime.
  • Regulatory penalties.
  • Legal claims.
  • Indirect damages.
  • Consequential damages.
  • Incidental damages.
  • Special damages.

The user accepts full responsibility for all actions performed using the software.

If the software is used in connection with vehicles, automotive systems, controllers, firmware, or electronic modules, all risks remain solely with the user.

9. Automotive Disclaimer

BinPlus may process or analyze automotive-related information.

The software is not approved, certified, validated, or endorsed by any vehicle manufacturer.

The Company does not guarantee compatibility with any vehicle, ECU, firmware version, hardware platform, or diagnostic system.

Users are solely responsible for verifying all outputs generated by the software.

10. Digital Products and Refunds

BinPlus is a digital product delivered electronically.

By completing a purchase, the customer expressly requests immediate access to digital content.

Once a license, activation information, software access, download access, or digital content has been delivered, refunds are generally unavailable except where required by applicable law.

If a customer encounters technical difficulties, support may be provided at the Company’s discretion.

11. Intellectual Property

All intellectual property rights related to BinPlus remain the exclusive property of GoodCar – Szymon Blacharski.

Customers receive a limited license to use the software and do not acquire ownership of the software.

12. Governing Law

These Terms shall be governed by the laws of Poland.

Any disputes arising from the use of the software shall be subject to the jurisdiction of the competent courts of Poland.
